Winning Your Disability Case With A Hearing

Social Security disability cases are being denied at record levels. About 60-70% of initial applications are denied by the Social Security Administration. After a claimant receives a denial, it does not mean that they will not be entitled to disability benefits. It means that the disability analyst at the state agency rejected the disability claim. Once this happens, a claimant can appeal this decision and have their case heard in front of Administrative Law Judge.

In the state of New York, after a claimant files an appeal, their case is transferred to the hearing level. While the numbers of denials at the initial application continue to rise, a claimant’s chances of success at the hearing level are much different.
