The government is not going to approve all of them and the denial rate for initial applications is about 75% on a national level.

In most states, including New York, once you’ve appealed your denial, your case will be heard in front an Administrative Law Judge. These informal proceedings are beyond important. Preparation is key and properly testifying will determine whether you are approved or not.

But is there anything you can do to improve your chances before even stepping into the courtroom?

There are thousands of people in Brooklyn right now that are seeking social security disability benefits. The Judges in Brooklyn see countless claims each month and it’s beyond crucial to be absolutely prepared before your hearing comes up. If you are looking for experienced disability lawyers in Brooklyn, you have found them.

Don’t risk thousands of dollars by hiring an attorney who just “dabbles” in disability law. Doing so could result in a denial and could cost you a large sum of money. When hiring a lawyer, don’t be afraid to ask them how many disability claims they’ve handled in the past, or what their success rate is. No lawyer can guarantee you a result, but a good lawyer will break down the issues in your case and what hurdles need to be overcome.

At Markhoff & Mittman, we pride ourselves in representing the injured worker exclusively. We do that so that we can cater our practice to helping those who have become unable to work as a result of an injury or impairment. When thousands of dollars are at stake for you and your family, you want to be able to rely on effective representation. And that is just what you’ll get from Markhoff & Mittman.

The short answer to this question is “NO”. However, do you want to gamble potentially thousands of dollars for you and your family in the hopes that a Judge will grant your case? Are you prepared to face another rejection by the Social Security Administration, which in turn, results in another waiting game? Unless you are completely familiar with disability laws and you understand how to overcome the complex issues in your case, going into a disability hearing without an attorney is like stepping into a mine field. The result could be disastrous.

In several instances throughout the disability process, an attorney is not necessarily needed. It is certainly not a requirement. But if your application is denied upon an initial application, the next phase in the state of New York is the hearing level. Here, a Federal Administrative Law Judge will analyze the case and make a decision on whether or not you are entitled to benefits. An attorney who is well versed in the area disability law can be a world of difference in your case.

As with most attorneys, fees are associated with the representation of claimants, but the federal governement has regulated these fees. Most, if not all disability lawyers, adhere to a contingency fee system in which the lawyer is not paid unless the claimant receives a fully favorable decision.

To learn more about what a qualified disability lawyer can do for you at the hearing level, CLICK HERE.

To make matters worse, the hearing level takes place after a claimant has already been denied for benefits. I am not publishing this to discourage claimants. But I want disability-hopefuls to be aware of the process.

Every so often, the Social Security Administration releases a ranking report to the general public in an effort to show how efficient – or inefficient – their specific hearing locations are. While this list includes every hearing office in the United States, it’s just an average and should be treated as such.

Disability hearings can be scary propositions. Claimant’s who finally get a hearing date know that they have already been denied once by the Federal government. Now a Federal Judge is going to review the case and decide whether the initial application should have been approved. There is nothing fun about a courtroom. Nor is there anything calming about a Federal Judge.

Nonetheless, hearings are an important step in the disability process if claimant’s are determined to be deemed disabled by the Social Security Administration. But while most people understand what a hearing is, many misunderstand what actually takes place at a hearing.

Certain disability claims are complicated. The medical evidence might be highly complex and often times, the procedural aspects of your case might also be difficult to understand. If this is the case, Administrative Law Judges frequently allow claimants to delay, or adjourn, their case so the claimant can seek representation.

As I’ve mentioned many times before on this blog, hiring a lawyer can seriously increase your chances of getting disability benefits. But when a Judge recommends that you hire a lawyer for your claim, it’s usually an indication that you should be represented by an attorney.
