The Social Security Administration will see upwards of 4 million applications for disability benefits this year. The government is not going to approve all of them and the denial rate for initial applications is about 75% on a national level.

In most states, including New York, once you’ve appealed your denial, your case will be heard in front an Administrative Law Judge. These informal proceedings are beyond important. Preparation is key and properly testifying will determine whether you are approved or not.

But is there anything you can do to improve your chances before even stepping into the courtroom?

As a disability lawyer here in New York, I appear on behalf of my clients at hearing centers located in the Bronx, Manhattan, Brooklyn, Queens, Long Island and upstate New York. Often times, I see claimants at the hearing offices without an attorney. Now I don’t know the details of their case, or what is preventing them from working, but I do know that they will be appearing in front of a Federal Administrative Law Judge and will be asked to testify to under oath. I also know that they will be asked whether they object to anything in their file. Without the representation of a qualified disability lawyer, how will this claimant know if their rights are really being protected?

If you, or someone you know, are hesitant to hire a qualified disability attorney, think again. CLICK HERE to read up on a few scenarios where a claimant can really get burned if they choose to represent themselves at a hearing.

The United States government is in a race against time to pass a deal to increase our nation’s debt ceiling. Failure to do so could have major ramifications across the world’s financial markets. In short, if our government fails to raise the debt ceiling, something that former President Ronald Raegan did 18 times while in office, our country would essentially default on it’s debts. To put in laymans terms, the United States would not be able to pay its bills.

What does that mean for Social Security Disability recipients?

Unfortunately, we do not have a definitive answer just yet. Major media outlets are reporting that if the United States defaults, social security checks will not be sent out on time, setting off what could be a catastrophic financial disaster. The government will default on it’s contracts with small businesses; individuals will not be able to pay their bills; interest rates will sky rocket due to widespread default.

I want to point out that this is the extreme scenario. In the event our elected officials can’t come to an agreement, President Obama can invoke his 14th amendment right to raise the debt ceiling in an attempt to avoid financial disaster. This can be done without congressional approval since the 14th amendment states that “the validity of public debt…shall not be questioned,” hence no congressional approval.

We’ll just have to see what our government does in these final hours, but it looks like the President will probably save the day in the final hour. CLICK HERE to check out this great article on cnn.com about whether social security checks will be sent out on time.

There are thousands of people in Brooklyn right now that are seeking social security disability benefits. The Judges in Brooklyn see countless claims each month and it’s beyond crucial to be absolutely prepared before your hearing comes up. If you are looking for experienced disability lawyers in Brooklyn, you have found them.

Don’t risk thousands of dollars by hiring an attorney who just “dabbles” in disability law. Doing so could result in a denial and could cost you a large sum of money. When hiring a lawyer, don’t be afraid to ask them how many disability claims they’ve handled in the past, or what their success rate is. No lawyer can guarantee you a result, but a good lawyer will break down the issues in your case and what hurdles need to be overcome.

At Markhoff & Mittman, we pride ourselves in representing the injured worker exclusively. We do that so that we can cater our practice to helping those who have become unable to work as a result of an injury or impairment. When thousands of dollars are at stake for you and your family, you want to be able to rely on effective representation. And that is just what you’ll get from Markhoff & Mittman.
