Day 2 at NOSSCR’s Fall 2010 Disability Law Conference was a busy one. Markhoff & Mittman was there to take it all in. We had the pleasure of hearing from Judge David F. Hamilton who gave an interesting perspective on social security disability cases through the eyes of an Appellate Court Judge.

Attendees also had the opportunity to hear from Social Security Administration Deputy Commissioner Glenn Sklar. This was a phenomenal opportunity for us lawyers to find out just exactly what the Administration is doing – and plans on doing – to improve the disability program. With all the talk about Social Security funds disappearing at a rapid rate, Sklar reassured us that the disability program is not going anywhere. That said, many changes are coming. Sklar did mention that the number one priority of the Social Security Administration is to reduce the backlog of pending disability cases.

The highlight of the afternoon session included a forum on Social Security’s new electronic records access. Attorneys and representatives now have access to their claimant’s files right over the internet. The in-depth discussion taught attendees how to use the program, how efficient it can be and lastly, how to troubleshoot.

Day 2 was jam-packed with new and exciting things that face the Social Security Disability program. Day 3 should be just as good so stay tuned…..

A quick THANK YOU to all of America's workers this Labor Day 2010

Happy Labor Day

Not many people are happy while laboring but the idea is right. We need to thank ALL American workers (especially in these tough times) for the social and economic achievements that have made America the greatest country on this planet! I don’t really care too much for what one side of the political specturm or the other has to say on issues right now, but I just want to take a moment to say thank you – we truly live in a blessed Country that has and will continue to not just produce but to create some of the most important items and ideas in the world.

Labor Day came out of the late 19th and early 20th Century Labor Movements but the ideals are simple and important – Labor Day celebrates America’s Workers’ - a tribute to the contirbutions, the prosperity and the well being of our Country —

From myself and my entire team – THANK YOU AMERICAN WORKERS!

Brian Mittman and the Markhoff & Mittman team – serving injured workers and their families since 1933!

After showing claimant’s how they can win their case by meeting a medical listing, the next way to get a favorable decision from the Social Security Administration is through a discussion about the claimant’s past work history.

A claimant’s work history is crucial to the determination of whether a person can be rendered disabled because it shows what the person was able to do when healthy. In the world of Social Security Disability, a claimant needs to show that he/she is not only incapable of performing their last work, but it also incapable of performing ANY other job in the local or national economy.

If the claimant can only prove they cannot perform their last work, they may get denied even at the hearing level.

The Social Security Administration certainly wants to know about a claimant’s physical or emotional impairments. But did you know that a claimant’s employment history is a major factor in whether a claimant can be determined disabled?

A work history provides insight into how long a potential disability recipient has contributed into the Social Security system. Someone with a long and steady work history will be favored by a disability ananlyst or Administrative Law Judge because the program was designed to compensate individuals who have contributed into the system.

A work history also provides information about the claimant’s job skills. Claimant’s who have held supervisory roles or positions that require a particular skillset might be more employable than a claimant who has worked in one industry all of their lives.

Social Security is interested in a person’s work history over the last 15 years. Each and every job held in the last 15 years can potentially shed light on what a claimant might be able to do in the workforce.

For more information about why an employment history is important to a disability claim, please visit www.markhofflaw.com

In New York, when you are denied benefits at the initial application stage, you case is transferred to the hearing level where you will have to appear in front of an Administrative Law Judge and offer live testimony why you are unable to work.

For many people, court proceedings can be a nerve-wracking experience. You are sworn in during the proceeding and subject to the penalties of purjury and while the rules of evidence are relaxed in a disability hearing, this is really your “one-shot” chance to tell the Judge why you are disabled.

You don’t want to forget anything in the hearing and if you do, it could cost you your benefits.

But what if you could avoid the hearing all together and still win your social disability case? Well, you can.

You’ve applied for social security disability. Your case has been denied upon your initial application and now you must wait several months for a hearing date. Depending on where you live, you might wait up to 20 months for a hearing date.

While you are waiting, the expenses begin to pile up. Your savings account is dwindling and pretty soon, you be relying on credit cards to pay for everyday things. Unfortunately, this is the most frustrating part about a disability claim. Waiting for Social Security to make a decision on your case, or allow you a hearing date takes a very long time.

So what are the ramifications on your case if you return to work in some capacity?

What if you start a job part time working minimal hours a week?

This question is so frequent in the area of Social Security Disability law because most people’s disabilities begin long before they stop working. There are the easy cases where a claimant is hurt at work or is the victim of a car accident and Social Security can pinpoint the date of disability. But many cases involve degenerative changes in the body that slowly affect a person’s ability to function on a daily basis.

Everyone applying for Social Security Disbability will be asked to allege a specific date that their disability began. But what is Social Security referring to?

Is it the date I began to suffer from severe pain?

Is it the date my doctor said my condition will worsen if I continue to work?

Is is the date I stop working?

To learn more about this “alleged onset date,” read this detailed article about how this date can affect a disability claim.
